Terms of Service

The rules of working together, written to be read rather than to be survived.

What we agree on

Before any work starts you get a written proposal with a fixed price, a fixed launch date, and a list of what is included. That proposal, plus this page, is the agreement. If the two ever disagree, the proposal wins.

Payment

The build fee is paid in two stages: half to book the dates and half on launch day. Invoices are due within fourteen days. The monthly plan starts the month after launch and is billed at the start of each month.

Who owns what

  • You own the finished site: the design, the code, the text and the images we produced for it.
  • You own the domain and the hosting account, in your name, from the start.
  • We keep the right to show the work in our own portfolio, unless you ask us not to. Asking costs nothing and we will not argue.
  • Anything you supply stays yours, and you confirm you have the right to use it.

Timing

The launch date holds as long as content, feedback and approvals arrive when the proposal says they will. If we miss the date for a reason of our own, the final invoice is waived. If the delay is on your side, we tell you the new date on the day it becomes clear.

Changes to the work

Extra pages or features asked for mid-project get their own price and their own date, agreed in writing before anybody starts them. Nothing gets added to your bill without you seeing the number first.

Stopping

Either of us can stop the project at the end of any stage. You pay for the work completed to that point and you take the files as they are. See the refund and cancellation policy for what that means in money.

What we do not promise

  • Search rankings. Nobody can promise those, and any studio that does is guessing.
  • A specific number of enquiries or sales.
  • That third party services outside our control will stay available forever.

If something goes wrong

If we built something incorrectly, we fix it at no charge, whether or not you are on a Care plan. Beyond that, our liability is limited to the amount you have paid us for the project. We are a small studio and cannot carry unlimited risk, and you should know that before you sign rather than after.

Placeholder: the registered company name, company number, registered address, contact email and governing country still need to be filled in by Octana Dx Co. before this page is published. Everything else on this page describes how the site and the studio actually work.
